Terms of Service
Last updated 2026-09-13
Draft awaiting review by [ENTITY NAME]. Items in square brackets are placeholders to be completed before launch. Australian Consumer Law guarantees apply and nothing here limits them.
These terms are an agreement between you and [ENTITY NAME] (ABN [ABN]) for the use of KindyStudio. By creating an account you accept them, together with our Privacy Policy, our Refund Policy and our statement on how we use AI.
1. Who can use KindyStudio
- You must be 18 or older and, if you use it for a service, authorised by that service to do so.
- One person per account. Keep your password private; you are responsible for what happens under your login.
- Accounts are for early childhood educators, services and families. We may refuse or close accounts used for anything else.
2. What you get
- Credits, bought as packs or included in a plan, spent on resources at the price shown before you confirm.
- New accounts receive a free starting credit balance once the email address is confirmed. It is a gift, not money, and has no cash value.
- Each resource is made once you confirm. Generation usually takes a few minutes. If a resource fails to complete, the credits for that attempt are returned automatically.
- Plans renew monthly until cancelled, at the price shown when you subscribed. You can cancel online at any time from the Billing page; the plan then runs to the end of the month already paid and does not renew. Plan credits are added each billing period.
- Unused credits do not expire, whether they came with a plan or a pack, and they stay yours after a plan ends. See the Refund Policy for money refunds.
- Once a plan has run for six months, and every six months after that, the Billing page reminds you of its price and how to cancel.
3. Your content and children's information
- You are responsible for what you type. Enter a child's first name only with the family's consent, and never a surname, photograph, date of birth, health or family detail. The service refuses names of more than one word, and asks you to confirm consent each time.
- You must not request content that is violent, sexual, hateful, medical, religious instruction, about a real person, or that reproduces a copyrighted character or brand. Our screening refuses what it recognises; you are responsible for the rest.
- You must not attempt to instruct, trick or probe the AI, scrape the service, share an account, or create accounts by script.
- You keep ownership of what you type. We grant you a licence to use the resources you make for early learning purposes, including printing, displaying and sharing them with families. You may not sell resources made with the free credits, and you may not resell any resource as a product [CONFIRM: commercial use terms].
- Resources are generated by AI and may contain mistakes. You must review every resource before using it with children. We make no promise that a resource is suitable for a particular child or program.
4. Sharing
Share links are for families and colleagues. A share link shows the resource, including any child’s first name inside it, to anyone with the link. You are responsible for who you give it to. We may disable a share link, or a resource, that is reported to us or that breaches these terms. A child's parent or carer can also turn a share link off from the share page; you will see a notice on the resource and can share it again if that is right for the family.
5. Payments
- Prices are in Australian dollars and include GST where it applies [CONFIRM: GST registration].
- Payments are processed by Stripe. We never see or store your card number.
- Credits are charged when you confirm a resource. If a resource fails, that attempt's credits are returned. Redoing or retrying a resource is charged at the price shown.
- See the Refund Policy for cooling-off and refunds of unused credits.
6. Suspending and closing accounts
- You can close your account at any time from Settings. Everything you made is deleted, your subscription is cancelled, and unused credits are forfeited unless the Refund Policy says otherwise.
- We may disable an account that breaches these terms, that is used to make unsuitable content, or that we reasonably believe is compromised. A disabled account cannot sign in, and its share links stop working. Contact us if you think that is a mistake.
- We may close the service with 30 days notice, refunding unused paid credits.
7. Our responsibility
Australian Consumer Law gives you guarantees that cannot be excluded. Beyond those, [ENTITY NAME] is not liable for loss caused by a resource you chose to use, by content you entered, or by interruptions to the service, and our liability for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss.
8. Changes and contact
We may update these terms; we will post the new date above. If a change is to your disadvantage (for example a higher plan price) we will email you at least 30 days before it takes effect, and you can cancel before then without any charge for the change; credits you already hold keep their value in credits. Questions: [CONTACT EMAIL]. These terms are governed by the laws of [STATE], Australia.
